Bura Girls' High sued for suspending Muslim students

Bura Girls High School is located in the Mwatate constituency in Bura  has been on the news currently.This is due to the fact that some pupils were suspended for refusing to attend a church service as per the school rules citing that there faith could not alloe them to do so.

Parents of the 38 students who were suspended from Bura Girls' High School in Taita for allegedly refusing to attend a church service yesterday sued the school.The parents want their children to go back to school.

Through lawyer Hamisi Mwadzogo, the parents asked the High Court in Mombasa to certify the matter urgent as the students are out of school. Mr. Mwadzogo asked Justice Mary Kasango to revoke the girls' suspension, pending determination of the case.

He urged the court to restrain the school board from convening a disciplinary committee against the students, which is to be held on July 9. The board of management Bura Girls' High School, the county director of education Taita Taveta county and the Attorney General have been named in the suit.

The parents also want the court to compel the school and the AG to allow the Muslim students back to school and continue with studies unconditionally and prevent them from attending any non-Muslim religious function. The school alleges in the suspension letter that the students were disobedient to school authority and negligence to school routine.

The parents argued that the suspension contravenes the students' rights as a church service is inconsistent with their Islamic faith.

The judge ordered the applicants serve the respondents and appear before Judge Anyara Emukule on July 6 for direction.
